Question about Using diplomatic clause

Agony Uncle,有些租客和房东的细节想咨询你,情况比较复杂,谢谢你

1, 和房东签订了两年的房租(整套),当时押金2个月,现已经到期。房东劝我们现在续约时,不要继续用以前的agent,这样可以省下agent fee.我们也同意了,口头上同意了续约一年以及确定租金的上涨幅度。 
2,原本应该再签续约合同,不过房东一直说忙,拖了3个多月了,(5月到期的)还没过来签合约。这3个月,我们也都按时,按口头约定的新房租网上汇款给他。

现在的问题是
1,原来的两个月押金,应该如何保障?原合同到期,也还没签订新合同,原本的合同原件,被房东借去说是为新合同做参考。(恩,其实房东也有一份的,当时没多想,就给他了)
2,突然有打算离开新加坡,可能9月底离开,现在我是否能用diplomatic clause这一条,
要求原房东退还押金,“This clause is to safe guard you if in the event you are no longer employed, transferred to other countries, you can terminate the lease after 12 months by giving 2 months notice” 这个12个月如何理解,我原本的两年是否能算在内?
3,通常情况下,租期未满就离开,是按照什么标准赔偿房东?包括应该提前多久通知,多少押金能退还?

这现在这种没有合同的情况下,我应该如何保障自己利益?
是应该先催促房东签订新一年的合同,还是应该现在就和房东讲,有可能离开新加坡?

这两个月押金,还能拿回来么? 谢谢

If no new tenancy agreement is entered into the agreement will run on a month to month basis unless stated otherwise.
If that is the case the diplomatic clause does not apply, there is the case you can just give one month’s notice.
Normally one needs not give compensation if terminated in accordance with the agreement.
The two month’s rental deposit is normally returned after deducting expenses for restoration and repair.

还有两个问题,1, 现在没有任何证明我们有付过两个月押金对么?上一个已经到期了,新的还没签,是否应该让房东写个证明
2, 如果要离开,房东应该在多久之内返还押金,有法律上的大概依据么? 要走了话,也不能永远的等他们对吧。

1. Were you given a receipt? That is not bar from claiming the two (2) months rental deposit from your landlord. If he was prepared let him sign something.

2. Within reasonable time and after the damages or expenses could be quantified.
