Enquiry about conflict of interest for job application

Thank you so much for providing legal and general guidance @ Huasing. A friend of mine asked me something about potential conflict of interest regarding her job application, which I have very limited knowledge. May you help to advise my friend on this?

The case is like this. My friend set up a small private limited company with her siblings in China; she is one of the enterprise's legal persons. Now she decides to move to Singapore and work in her “dream” company, which is of the same nature of business as her own company. I believe there is a conflict of interest if she is a legal person of one company and works for another of the same nature, isn’t it? I told her my opinion. Since all other legal persons and employees need to carry business as usual to earn a living, my friend cannot simply dismiss her company. In this case, what should she do to solve the interest conflict so that she won’t have obstacles in her job application, and at the same time the small company does not have to be dismissed? Can she drop off her legal person’s status, and ask her siblings to take over her position? Does she need to transfer all her shares/rights/whatever to her siblings as well? Or the only way is to dismiss the company?

Yes. Certainly there is. She can discharge herself of all interest in the china co.
Alternative she can declare her interest to the dream company and let them decide how to resolve the issue.
